One of the onerous elements of the law creates a “private right of action” that would allow anyoney, without a court being involved, to effectively shut down a website. You can imagine a number of scenarios - whistleblowers being shut down, or a successful political ad in the days before an election being shut down by opponents. Now I'm sure that's not the case. It's going to be difficult to sanction other countries for their human rights offenses when we can't even stick to the First Amendment. It appalls me that this debate has taken up so much of Congress' time when the hypocrisy is so obvious. There is a lot of brain power represented in the signatures of the open letter. If someone has done a copy - paste of your copyrighted material, send them a cease and desist letter giving them a week to remove the plagiarized content. If they refuse to remove it, you can initiate legal action but that would incur a cost. So it boils down to a cost benefit analysis for you. Any legal scholars out there with any input? Yes and yes! My site has a lot of completely unique content I've either written myself or outsourced but it appears a lot of it is popping it up all over the web without my agreement.
